National Seminar On IPR: Issues And Challenges

19/01/24: The inaugural ceremony of the National Seminar on Intellectual Property Rights -Issues and Challenges marked the commencement of a significant academic event that witnessed an esteemed gathering of academicians, advocates, experts, scholars, and distinguished guests to delve into the complexities surrounding intellectual property in today's dynamic environment and to lay emphasis on the IP developments and their application in India.

Lighting of the Lamp by Dignitaries

The ceremony started on the pleasant morning of 19th January 2024 with BSSS Anthem wherein everybody stood up to show their respect.  Dr. Sheena Thomas, the MoC of the ceremony, welcomed the guests to be seated on the dais and shed light on various legal and ethical areas of Intellectual property rights. She also talked about how the emergence of AI-generated deep fakes has raised significant concerns in the realm of Intellectual Property Rights (IPR).

The program started with the customary lighting of the lamp as the symbol to invoke the blessings of the Almighty by Fr. Jomi Panithas (Dean, Academics, BSSS), Sr. Dr. Sonia Kurian (Vice Principal, BSSS), Dr. Arti Mudaliar (Convener) and all the dignitaries.

A unique welcome was accorded to the esteemed guests by presenting them with flower saplings, neatly tucked in ethnic khadi and ajrakh print potlis prepared by Asankhya Creations, one of the start-ups of BSSS Incubation Centre to show a mark of respect and highlight environmental consciousness.

Floral Welcome by Dean Academics Fr. Jomy Panithas

Fr. Jomi Panithas welcomed all the esteemed dignitaries, guests, staff, and students. He talked about the rights we have on physical property but also raised questions on the protective rights of the human intellect. He said with the help of this forum lot of challenges and issues of IPR will be tackled as we get to hear from the eminent speakers and various presenters who will present their research papers during the seminar. He wished luck to the organizing committee for the conduction of this two-day seminar and congratulated them for bringing in experts from different parts of the country. Lastly, he thanked the distinguished guests present for the seminar. The invited eminent guests included the Chief Guest, Dr. N.K Choubey (Sr. Principal Scientist, MPCST), the Keynote Speaker Prof. (Dr.) Ghayur Alam (Head of the Department of IPR & Business Law, NLIU), the Guest of Honour Mr. D.D. Gajbhiye (Joint Director & HOD, MSME DFO, Indore), Special guest Mr. Gaurav Goyal (Assistant Director, MSME, DFO, Indore), and the subject expert Ms. Moumita Gorai (Assistant Manager, CIPAM, New Delhi). Ms Moumita joined the inaugural session in online mode.

A brief about The Bhopal School of Social Sciences and its comprehensive approach to learning to achieve academic excellence as it gradually adopted new programs and bold steps to go beyond the prescribed curriculum was given by Dr. Sheena Thomas. She also spoke about the BSSS Incubation Center and its efficient leader Dr. Arti Mudaliar who is also the nodal officer and convener of the seminar.

Address by Convener Dr. Arti Mudaliar

Dr. Arti Mudaliar, convener of the seminar, threw light on the theme of the Seminar and informed how this seminar was conceptualized and the expected outcome of the Seminar. She addressed all the dignitaries for the day and thanked MPCST for sponsoring the two-day national seminar on Intellectual Property Rights – issues and challenges. She highlighted that Intellectual Property rights have grown to a point where it plays a key role in the development of the global economy to enhance creativity, innovation, competitiveness, and economic growth in India. She said that this seminar holds importance to the institutions and the nation as people lack knowledge of the rights of individuals to protect their ideas and have low awareness about the procedures involved in obtaining an IPR which has hindered India’s growth. She discussed the seminar structured into three technical sessions that cater to the curiosity and interest of all. The first track will cover the overview of creating an IPR ecosystem, innovation, commercialization, and IPR contributions for start-ups and entrepreneurs, and future trends and challenges. The second session will deal with emerging technologies and an IPR in the digital economy. The two technical sessions were conducted on the very same day in the afternoon session which is from 2 to 5 PM. The third technical session included IP enforcement and litigation and global IPR landscape which was scheduled for 20th January 2024 in the morning session starting from 10 am to 1 pm. She also said that this two-day national seminar will present a comprehensive, holistic picture and will prove to be a fruitful forum for discussion of IP development and its applications in India. She also wholeheartedly welcomed all the subject experts and participants to the seminar.

Address by Guest of Honour, Mr. D.D. Gajbhiye

The Guest of Honour, Mr. D.D. Gajbhiye (Joint Director & HOD, MSME DFO, Indore), was then invited to speak and enlighten the audience. He talked about various schemes and options offered related to IPR and trademarks. He kept on emphasizing the pivotal role of intellectual property in fostering innovation.

Keynote Address by Prof. (Dr.) Ghayur Alam

The Keynote speaker, Prof. (Dr.) Ghayur Alam started his talk by emphasizing the paramount importance of acquiring a deep understanding of the vocabulary associated with Intellectual Property Rights (IPR). Dr. Alam stressed that we must delve into the eight types of IPR, comprehending what each type protects. In his address, Dr. Alam underscored the significance of fostering creativity, encompassing both useful and aesthetic aspects. He urged the audience to actively promote critical thinking, recognizing that many of us dwell in a world of second-hand knowledge.

The pertinent question he posed is, "What new knowledge have we created, or what innovative technology have we contributed?" Dr. Alam highlighted the challenge of living in a world saturated with pre-existing information. He emphasized that true progress occurs when we create new knowledge or pioneer innovative technologies. Achieving this, he argued, requires the establishment of a conducive environment for creativity—an essential challenge that must be addressed. In conclusion, Dr. Ghayur Alam's words serve as a call to action, urging us to not only understand the intricacies of intellectual property but also actively cultivate an environment that fosters creativity, innovation, and the generation of new knowledge.

After the concluding words of Dr. Ghayur Alam, Dr.  Sheena thanked him for creatively introducing IPR to everyone. She also said that these questions posed by Dr. Alam will help all of us to travel on the journey of innovation.

Ms. Moumita Gorai (Assistant Manager, CIPAM, New Delhi) was the subject expert who joined the seminar through the online platform to share her knowledge. She started by discussing the basic meaning of the word Intellectual property rights wherein she said that the word intellectual itself means intellect something which gives us the power and creativity to think. An idea is also a form of property. That can also have a copyright. She also discussed various facets of IPR and gave lots of live examples of innovative products. She emphasized the differences between innovation, invention, and discovery. Dr. Moumita was applauded for sharing insights on the pertinent areas of intellectual property rights.

Address by Chief Guest Dr. N.K. Choubey

The Chief Guest of the day was the invited Dr. N.K Choubey (Sr. Principal Scientist, MPCST) to address the gathering. He first thanked the entire college management for organizing this seminar. Mr. N.K. Choubey captivated the audience through creative storytelling, emphasizing that intellectual property rights represent a comprehensive set of entitlements.

Drawing an analogy, he linked IPR to a matchbox, highlighting that the sticks, much like individual rights, are ineffective without the matchbox as a whole. He recommended several websites as valuable resources for obtaining additional information on intellectual property rights.

Dr. Sister Sonia Kurian presented the memento to Dr. Alam as a token of love and gratitude. Dr. Ashish Dilraj, HOD, Department of Commerce was invited to present a memento to Chief Guest Mr. N.K Choubey. Dr. Sheena again thanked all the distinguished guests for their valuable time. The inaugural session concluded with the National Anthem.

The session began by introducing the term IPR, with a warm welcome to the chairperson Dr Meenakshi Rathi, and subject expert MM Bedkar. It continued with introducing The Bhopal School of Social Sciences with its history and accolades. Furthermore, an introduction to the ED Cell of the college was given, and how efficiently it is being handled by Nodal Officer Dr Arti Mudaliar, who is the Convener of this Seminar. Moving ahead with the introduction of chairperson Dr. Meenakshi Rathi who has 15 years of teaching experience as a Commerce and Management Faculty is currently working as Assistant Professor of Commerce in the Institute for Excellence in Higher Education, Bhopal. She is the Member and resource person of the Madhya Pradesh Higher Education Department E-Content Development and Validation Team. She is a Certified Trainer for NCERT New Delhi and HRDC Central University Sagar. She has Published 2 books and more than 20 research papers in National and International Journals, also received the Best Paper Presentation Award in the National Seminar at Barkatullah University 2019 and was awarded as the best paper presenter at MPHED National level Seminar 2023. 

The session continued with introducing the subject speaker Dr. M.M Betkar, Principal, Shri Kumarswami Mahavidyalaya, from Maharashtra. 

His expertise and knowledge remain widely acknowledged. Dr. Betkar is a Research Supervisor with 30 years of teaching experience. He has 07 Patents in his name. He has also been invited by the International Conference as a Keynote speaker in Singapore, Hong Kong, Canada & UK and has more than 50 Research Papers to his credit. 

He has multiple awards to his credit including Gold Medal for his research innovation from the State Government of Maharashtra, under the Inter-University Research festival, Best Principal-2021, awarded by SRTM University, and awarded Best Teacher of the Year 2018 by IASR institute, Kolkata. He has published a Book on NAAC SSR preparation. He has Organized more than 600-International & National events and has recorded his name in the International Book of Records, India Book of Records & Asia Book of Records-2022.   After the introduction of the eminent personalities, with their permission the technical session began.

The mode of presentation was online. The speaker started by stressing the power of knowledge. She also stressed the role of education with the relevance of its quality, how IPR is of importance in higher education, and said that India although has a high number of literate people still does not have a competent workforce because of limited innovation and practicability.  She stated that IPR not only creates knowledge but also protects the IPR of the creators. It has been found that Geographical Indications have boomed in the current scenario. She stressed that whatever new has been introduced helps in economic growth as it develops royalty with the protection of consumer rights. It also helps in international collaboration, and it is an intangible asset. The study is descriptive and secondary data was used. The speaker stressed that there should be government interventions for supporting and promoting IPR which will help foster the economy, raising the benchmark of higher education. She suggested that the stakeholders should be taking utmost care by developing IPR in the curriculum and striking a balance between misuse of creative knowledge.

The presentation was related to the startup ecosystem. The students adopted offline mode by introducing the start-ups and IPRs. IPR plays a pivotal role in saving the fruits of people who have worked a lot. Contracts and agreements help in the smooth flow and preventing disputes and by getting patents startups can be secured. The research methodology adopted is descriptive and secondary data has been referred to. They also discussed the challenges faced by the start-ups. The presentation concluded by saying that startups have limited financial resources and enforcing legal rights can be time-consuming and costly. It was suggested that proper rules can help in implementing the same.

They took forward their presentation by case study of the Apple iPhone and its conflict with Samsung for Patents. Apple filed an infringement case against Samsung and finally, it was concluded that Apple was compensated with 500 million dollars due to its unique design as they protected it with IPR and Samsung got compensation for wireless technology. Finally, the researchers suggested proper laws can help in framing the best results.

Unlocking Innovation: Embracing the Positive Impact of IPR Expiration in India

The students presented offline with special reference to the pharmaceutical industry. It focused on IPR Expiration and said that this adds to the public domain and public knowledge. An example quoted was electronic metros.  Their research adopted the primary data collection technique with a sample size of 180 questionnaires and analysis was done on 120 complete responses received. They concluded that there must be a balance between IPR Expiration and new IPR and also active participation was from the student community and the finding showed that people only know a bit about patents in the context of IPR. This requires a forward-thinking approach in all the diverse sectors.

He focused on the use of effective retailing while laying down five null hypotheses. The study was conducted with the help of a questionnaire. He used the chi-square test and concluded that organized retailers have taken up the market of organized retailers. It was concluded that there is less footfall in the unorganized sector. The suggestions were made that the organized sector had a huge profit margin and the customers had no special preference as they were focussed on product availability.

The objective was to evaluate how it affected the engagement with course materials, its effect on stress, and competition of syllabus, and how it hinders the knowledge and interaction with others. The study focused on both primary and secondary data and the sample was collected from MBA students from various institutes. The data was collected with the help of an online questionnaire. It applied thematic analysis to understand if there are issues such as cyberbullying that lead to bullying. They concluded that social media affects in both negative and positive ways. The effectiveness of interventions will be good in refining our understanding.

They concluded that Consumer’s attitude is directly related to convenient ways to get the required resources. The emergence of these sectors has created better experiences for the customers. The previous online experience may create trust or have a negative impact.

After the technical sessions, the subject expert and chairperson shared their valuable suggestions. They advocated the importance of research in the current scenario and how students play a vital role in the development of New India. Dr. Meenakshi Rathore stresses that IPR is an emerging and never-ending topic, and the topic is booming and still has lots of scope and limitations. Thus, she said that we need to learn, unlearn, and relearn about this trending topic.

The first day of the National Seminar on IPR (Intellectual Property Rights) of track – I ended with a Vote of Thanks, proposed by Dr. Arti Mudaliar, Convener, for the program. A heartfelt appreciation was forwarded to M.P.C.S.T and the management of The Bhopal School of Social Sciences for the arrangement of the Seminar. A cheerful appreciation was proposed to Dr. Fr. The speaker introduced the food delivery app industry in the UAE and its demand for digital or technological advancement. The study was conducted with the help of secondary data.

UAE is the 2nd largest market for food delivery.

The food delivery users are high with 2 billion members. The main objective was to examine the factors that influence the customers and to observe the functionality of apps. The study reveals that even though the UAE has people from different nationalities it doesn’t affect the food delivery system and market in UAE. It was concluded that the primarily cost-free service and the timely delivery expectation are the key factors that hold the industry.

The suggestions were made that the study on the food delivery app industry in India would have been more efficient than UAE.

The Speaker addressed the audience with the proposed steps for IPR and suggested ways for data evaluation by using the state-wise prescribed data authenticity and approval for the property rights and its related proposals for the agent-based rights.  The speaker emphasized state-relevant systems for claiming the rights and the data evaluation from the traditional way to the technological way. Issues and challenges on IPR were highlighted. The presentation concluded with a discussion of future directions in information systems and data evaluation, predicting that this method will help in the future with legal issues for the right proposals and also help in technology for exceeding the technology in AI format. The queries arise on the difference between the proposed system from the existing system. The speaker clarified it by explaining the agent system.

The presentation focused on understanding the existing issues caused due to IPR in artificial intelligence and data using secondary data sources. Lack of clear guidelines, data privacy concerns, rapid technological evolution, and monopoly concerns were discussed. The speaker highlighted that AI is being used freely and frequently by users without knowing its functioning and negative impact which results in decreasing their productivity and affecting their privacy. The presentation effectively highlighted the complex challenges and urgent need for proactive solutions regarding IPR in AI for India. It included regulatory bodies, accountability and responsibility, data privacy and security, ethical guidelines, and testing and certification.

Report on Valedictory Ceremony of “National Seminar on Intellectual Property Rights: Issues and Challenges”

The valedictory ceremony commenced on 20th January 2024 with the welcoming of the Chief Guest- Dr. Sumit Bhattacharya- Faculty National Judicial Academy, Guest of Honour- Prof. (Dr.) Pavan Mishra- Dean Students Welfare, Barkatullah University, Principal Dr. Fr. John P.J. and Vice Principal Dr. Sr. Sonia Kurian by the MOC Dr. Richa Bhatia.

Felicitation of Chief Guest by Principal Dr. Fr. John P.J.

Dr. Fr. John P.J. congratulated the entire team of ED Cell, Department of Commerce, Education, and Science, who were instrumental in organising the seminar on such a contemporary issue.

Further, the Guest of Honour Prof. (Dr.) Pavan Mishra- Dean of Students Welfare, Barkatullah University appreciated the efforts put in by the management, faculty, and students of BSSS Bhopal in conducting the seminar and wished a very bright future full of success and prosperity for the institute.

Next in line, Dr. Anuradha Goswami- Organising Secretary briefed about the two days of the National Seminar in her executive summary and informed the audience that in total 183 participants attended the seminar from all over India. 

She further informed that keeping the present scenario in mind the Bhopal School of Social Sciences decided to conduct a National Seminar on Intellectual Property Rights: Issues and

Challenges for 2 days on 19 and 20 January 2024, Sponsored by the M.P. Council of Science & Technology, which is being conducted in Hybrid mode. This seminar began with an inaugural session on 19 January 2024. Fr. Jomi Panithas (Dean, Academics, BSSS) and Sr. Dr. Sonia Kurian (Vice Principal, BSSS) welcomed guests with saplings. The Guest of Honour for this session was Mr. D.D. Gajbhiye Joint Director and HOO of MSME DFO, Indore.

The Keynote address was given by Prof. Dr. Ghayur Alam-Head Department of IPR & Business Law, Dean Under Graduate Studies, NLIU, Bhopal. Further, Dr. N. K. Choubey- Senior Principal Scientist, MPCST, also addressed the gathering as Subject Expert. Ms. Moumita Gorai- Assistant Manager, CIPAM, New Delhi was another subject expert who provided valuable input to the audience. Further, Prof. (Dr.) Ghayur Alam delivered an enlightening offline keynote address and vividly explained all eight types of intellectual property rights.

Summarizing the tracks, Dr. Anuradha Goswami- Organising Secretary further informed that after the inaugural session, track one and track two were simultaneously conducted both in offline and online mode in the Main Seminar Hall and Main Conference Room.

The four Themes of track one were: Creating an IPR Ecosystem, Innovation, Commercialization and IP, Start-ups and IPRs, and Future Trends and Challenges in IPRs. The Chairperson of Track One was Dr Meenakshi Rathi, Assistant Professor, IEHE Bhopal and the Subject Expert was Dr M.M. Betkar Principal Shri. Kumarswami Mahavidhyalaya, Ausa, Latur Maharashtra. The total number of papers registered in track one were 19.

The themes of track two were – Emerging Technologies and IPRs and IPRs in Digital Economy. The Chairperson of Track Two was CS Arun Thapar, Assistant Registrar, Indian Institute of Information Technology, Bhopal and the Subject Expert was Ms. Soumya Kaushik, Associate Vice President, Elpis Analytix, New Delhi. The total number of papers registered in this track were 11.

The themes of track three was IP Enforcement and Litigation and the Global IPR Landscape. The Chairperson of this track was Dr Sarita Rana Associate Professor, Acropolis Faculty of Management and Research and the Subject Expert was Mr. Soaham Bajpai, Assistant Professor of Law, Gujrat National Law University. The total number of papers registered in this track were 23. She further informed that all the papers presented during these three tracks were well-structured, Informative, and Impactful.

 The Chief Guest Dr. Sumit Bhattacharya- Faculty of National Judicial Academy, thanked the management for inviting him to this seminar and appreciated the scope and coverage of the seminar. In his address, he explained that intangibility is the nature of any right and a right can be positive or negative. He further explained that validity is another important issue and in India, the grant of a patent does not ensure its validity.
